This Manual is published under section 51 of the Promotion of Access to Information Act, 2 of 2000 (“PAIA”), read with the Protection of Personal Information Act, 4 of 2013 (“POPIA”). It sets out what records De Klerk Turner Incorporated holds and how to request access to them.

1. About PAIA and POPIA

PAIA gives effect to the constitutional right of access to information. It allows any person to request access to records held by a private or public body where those records are needed to exercise or protect a right.

POPIA governs the lawful processing of personal information. It includes rights of access, correction and deletion of personal information held about you.

  • Correspondence (letters, email, instant messages) with clients, opposing parties and third parties
  • Pleadings, notices, contracts, agreements and other matter-specific documents
  • Counsel's opinions, expert reports and memoranda
  • Notarial protocols and original notarial deeds
  • Wills, codicils and estate-administration files
  • Trust deeds, minute books and trustee resolutions
  • FICA verification records (identity, address, source of funds)

5.2 Firm records

  • Constitutional documents (Memorandum of Incorporation, share register, director registers)
  • Financial records (general ledger, trust account records, audited financial statements, tax records)
  • Insurance records (professional indemnity, fidelity, general business)
  • Risk Management and Compliance Programme (RMCP) under FICA

6. Records automatically available without a formal request

The following information is published or available on request without invoking PAIA:

7. How to request access to a record

A requester who wishes to access a record held by the firm must:

  1. Complete the Form 2 prescribed under PAIA (available from the Information Regulator or from our Information Officer on request).
  2. Submit the completed form by email to info@dkt-inc.co.za (marked for the attention of the Information Officer) or by post to the address in section 2.
  3. Identify the record requested with sufficient particularity for it to be located.
  4. Identify the right that the requester wishes to exercise or protect, and explain why the record is required for that purpose (where the requester is not the data subject).
  5. Pay the prescribed request fee (where applicable) and the prescribed access fee in respect of the time required to prepare the response, in accordance with the Regulations published under PAIA.

A request relating to the requester's own personal information should be made on Form 2; no request fee is payable for a request by a data subject for their own personal information, but access fees may apply.

8. Fees

The fees payable for access to records are set out in the Regulations under PAIA, as amended from time to time. Where fees are payable, we will provide the requester with a written estimate before processing the request, and the requester will have an opportunity to narrow the request in order to reduce the fee.

9. Grounds for refusal

Access may be refused on grounds set out in PAIA, including the protection of:

  • the privacy of a third party who is a natural person;
  • commercial information of a third party;
  • confidential information of a third party;
  • the safety of individuals and the protection of property;
  • records privileged from production in legal proceedings;
  • commercial information of the firm;
  • research information of the firm or a third party.

If a request is refused, the requester will be informed of the reasons for refusal and, where applicable, of the right to lodge a complaint with the Information Regulator or to apply to court for relief.

If you are dissatisfied with a decision on a PAIA request, you may lodge a complaint with the Information Regulator or apply to a court for relief.
